TERMS & CONDITIONS

By purchasing, downloading, accessing, receiving, or using any services, photographs, videos, digital files, products, or media from FitX Imagery, LLC ("FitX Imagery"), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
NO REFUNDS, EXCHANGES, OR CANCELLATIONS
All sales are final.
Due to the custom, digital, and service-based nature of our products and services, FitX Imagery does not provide refunds, exchanges, cancellations, credits, transfers, or substitutions under any circumstances unless otherwise required by law.
This applies to, but is not limited to:
• Photography packages
• Video packages
• Instant Stage Reels™
• Digital downloads
• Gallery purchases
• Event coverage
• Mini sessions
• Empower sessions
• Retainers
• Add-ons
• Upgrades
TURNAROUND TIMES
All delivery timeframes provided by FitX Imagery are estimates only and are not guaranteed.
Delivery may be delayed due to:
• Technical issues
• Equipment failures
• Staffing issues
• Venue restrictions
• Internet interruptions
• Cellular service outages
• Event schedule changes
• High-volume workloads
• Acts of God
• Circumstances beyond our control
Delays do not constitute grounds for refunds, chargebacks, credits, cancellations, or compensation.
SHOW GALLERY EXPIRATION
All event galleries expire the Friday following the event at 11:59 PM Eastern Time unless otherwise stated.
Expiration notices may be communicated through banners, social media, event signage, email, websites, and galleries.
Once a gallery expires, access may be permanently removed.
FitX Imagery is under no obligation to restore expired galleries.
CHOOSING YOUR PHOTOS
Competitors are responsible for reviewing all applicable divisions, classes, pre-judging, finals, comparisons, and routines.
Images are organized based on show flow and event structure.
Classes combined during competition may be displayed within the same gallery folder.
Clients are solely responsible for selecting their preferred images.
No substitutions, exchanges, or changes will be allowed once selections are submitted.
IMAGE QUALITY AND EVENT CONDITIONS
Clients acknowledge that FitX Imagery does not control:
• Venue lighting
• Stage lighting
• Promoter lighting decisions
• Competitor tanning
• Hair styling
• Makeup
• Posing execution
• Facial expressions
• Closed eyes
• Competitor positioning
• Obstructions caused by judges, athletes, staff, or audience members
FitX Imagery shall not be responsible for any dissatisfaction arising from factors outside its reasonable control.
PHOTO EDITING AND RETOUCHING
Images are delivered as photographed.
Retouching, Photoshop work, body modifications, skin corrections, object removal, or advanced edits are not included unless separately purchased.
WHAT WE CAPTURE
FitX Imagery is only obligated to photograph and/or record standard coverage as determined by FitX Imagery.
Additional angles, bonus shots, crowd shots, backstage shots, awards shots, comparison shots, creative shots, reaction shots, or specialty footage are not guaranteed.
FitX Imagery does not guarantee that every competitor will appear in every image or video.
VIDEO SERVICES
Video packages generally include individual posing routines only.
Comparison footage, awards footage, audience footage, backstage footage, and other footage may not be included.
Music captured during events may be affected by copyright restrictions, venue limitations, platform restrictions, technical issues, or audio quality limitations.
FitX Imagery does not guarantee inclusion of music in any video product.
INSTANT STAGE REEL™
Instant Stage Reel™ delivery times are estimates only and are not guaranteed.
While our goal is to provide reels within minutes after stage appearances, delays may occur.
FitX Imagery reserves the right to complete and deliver Instant Stage Reels™ after the event if immediate on-site delivery is not possible.
No refunds shall be issued solely because delivery occurred later than anticipated.
FitX Imagery does not guarantee specific camera angles, effects, transitions, duration, music, clips, visual styles, or editing choices.
All editing decisions remain solely at the discretion of FitX Imagery.
If an Instant Stage Reel™ cannot be completed due to technical failure, equipment malfunction, file corruption, venue restrictions, internet outages, or circumstances beyond our control, FitX Imagery's maximum liability shall be limited solely to the amount paid for that specific Instant Stage Reel™ service.
PACKAGES AND COMBINATIONS
Packages may not be combined between competitors.
Packages may not be transferred between shows.
Packages may not be split between individuals.
Violation of package rules may result in cancellation of included services without refund.
PERSONAL USE ONLY. Commercial use is not included.
Vendors, sponsors, coaches, brands, and companies must contact FitX Imagery before purchasing for commercial licensing.
MEDIA DELIVERY
Clients are responsible for checking:
• Inbox
• Spam folder
• Junk folder
• Promotions folder
FitX Imagery shall not be responsible for missed delivery emails.
Clients are responsible for providing accurate contact information.
MEDIA STORAGE
FitX Imagery does not guarantee permanent storage of any images, videos, galleries, or digital files.
Clients are strongly encouraged to download and back up all delivered media immediately.
FitX Imagery shall have no responsibility for maintaining long-term archives.
MEDIA USE AND COPYRIGHT
All photographs, videos, graphics, and media remain the exclusive intellectual property of FitX Imagery unless otherwise stated in writing.
Media purchases grant personal-use rights only.
Commercial use, advertising use, sponsorship use, publication use, promotional use, resale, redistribution, editing, alteration, AI training, AI generation, AI manipulation, or licensing to third parties is prohibited without written authorization.
Commercial licenses are available for purchase separately.
CHARGEBACKS AND PAYMENT DISPUTES
By purchasing services or products from FitX Imagery, the client agrees not to initiate chargebacks or payment disputes for services rendered or media delivered.
Any chargeback, payment reversal, fraudulent dispute, or unauthorized claim may result in:
• Collection activity
• Recovery of legal fees
• Recovery of administrative fees
• Revocation of usage rights
• Suspension of future services
Clients shall remain responsible for all amounts due.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, FitX Imagery's total liability for any claim, dispute, loss, damage, or cause of action shall not exceed the amount actually paid by the client for the affected service.
FitX Imagery shall not be liable for:
• Lost profits
• Lost opportunities
• Sponsorship losses
• Competition results
• Travel expenses
• Hotel expenses
• Emotional distress
• Consequential damages
• Indirect damages
• Incidental damages
• Special damages
LOSS OF MEDIA
While every precaution is taken to safeguard media, unforeseen circumstances may result in loss, corruption, theft, damage, deletion, or inaccessibility.
In the unlikely event of total media loss, FitX Imagery's sole liability shall be limited to a refund of monies paid for the affected service.
GOVERNING LAW
These Terms & Conditions shall be governed by and construed under the laws of the State of New York.
Any dispute arising from services provided by FitX Imagery shall be resolved exclusively in the courts located within the State of New York.
SEVERABILITY
If any provision of these Terms & Conditions is found unenforceable, the remaining provisions shall remain in full force and effect.
